Abstract

Between 1997 and 2003, the Electoral Court of the Federal Judiciary (TEPJF) issued several jurisprudential criteria whereby it increased its authority to resolve generated at the heart of political parties. Although several studies have addressed this issue from a legal point of view, quantitative studies are virtually non-existent. There is a lack of even the most fundamental information needed to empirically approach the phenomenon: the number and type of intraparty conflicts over time; their geographical distribution and political parties, and how victories between militants and party leaders have been distributed. The purpose of this article is, precisely, to fill this gap in the literature. Using a database that incorporates the universe of suits filed between 1996 and 2006, we show the principal trends in the reception and resolution of intraparty disputes by the Electoral Court of the Federal Judiciary.
